Baba Suwe’s Lawyer Wants Court Order holding him for 15 more days Vacated


Lawyer to Babatunde Omidina, aka Baba Suwe, Mr. Bamidele Aturu, this morning asked a Federal High Court sitting in Lagos to vacate its earlier order granted to the National Drug Law Enforcement Agency, NDLEA to detain the comedian for 15 more days, following suspicions that he carried some quantity of drugs in his belly.

•Baba Suwe now in NDLEA custody.
In the motion on notice brought under Order 26 Rule 11 of the Federal High Court Procedure Rules, Aturu asked the Court to vacate and discharge its order made on 21 October 2011 on the grounds that NDLEA misled and misrepresented facts before the court.
Aturu contended that the NDLEA in an attempt to secure the order, concealed material facts relating to the health and circumstances of the arrest and detention of Baba Suwe.
He also contended that the application filed by the NDLEA contained contradictory facts.
The application for the order the NDLEA obtained from the court to detain Baba Suwe, Aturu contended, was grossly irregular and constituted gross abuse of the court process.
At press time, no judge had been assigned the case and no date fixed for its hearing.
